本利用規約（以下「本規約」）は、Cram Farm（ぎゅう詰め牧場。以下「本サービス」）の提供者（以下「当方」）が定める、本サービスの利用条件です。本サービスには、Web版・アプリ版のゲーム本体および対戦・ランキング・ステージ公開などのオンライン機能が含まれます。利用者は、本サービスを利用した時点で本規約に同意したものとみなします。同意いただけない場合は、本サービスをご利用にならないでください。
本サービスは、鳴き声を手がかりにペアを揃えて遊ぶゲームです。基本プレイは無料で提供します。対戦・ランキング・カスタムステージの公開／検索などのオンライン機能の利用には、インターネット接続が必要です。通信料金は利用者の負担となります。
当方は、本サービスの内容（ゲームの仕様・バランス・モード・特典・提供範囲を含みます）を、予告なく変更・追加・削除することがあります。また、保守・障害・外部サービスの停止・その他当方が必要と判断した場合、本サービスの全部または一部を予告なく中断・終了することがあります。これらにより利用者に生じた不利益について、当方に故意または重大な過失がある場合を除き、当方は責任を負いません。（当方が責任を負う場合の賠償の範囲および上限は、第17条に定めるとおりとします。）
本サービスの利用に必要な端末・ソフトウェア・通信回線は、利用者がご自身の費用と責任で用意するものとします。すべての端末・ブラウザ・OSでの動作を保証するものではありません。
本サービスは13歳以上の方を主な対象としており、子ども向けサービスとして設計・提供していません。未成年の方は、あらかじめ保護者（親権者）の同意を得たうえでご利用ください。将来、本サービス内で有料の購入手段を提供する場合、未成年者による購入には保護者の同意が必要です。保護者の方は、端末側の購入制限・ペアレンタルコントロールの設定をご確認ください。
オンライン機能の利用には表示名の設定が必要です。表示名には、本名・住所・電話番号・メールアドレスなどの個人情報を入力しないでください。以下に該当する表示名は禁止します。
当方は、不適切と判断した表示名を、事前の通知なく変更・削除・非表示にすることがあります。表示名は他の利用者と重複することがあり、表示名によって本人性が保証されるものではありません。
オンライン機能は「現状有姿」で提供されるものであり、当方は、その継続的な提供・無停止での稼働・応答速度・データの保存期間について、いかなる保証も行いません。オンライン機能は予告なく変更・停止・終了することがあります。また、当方が利用するホスティング環境の仕様により、一定時間アクセスがない場合にサーバーが休止し、接続開始までに時間を要することがあります。サーバー上に保存された情報は、予告なく削除されることがあります。これらにより利用者に生じた損害について、当方に故意または重大な過失がある場合を除き、当方は責任を負いません。（当方が責任を負う場合の賠償の範囲および上限は、第17条に定めるとおりとします。）
利用者は、本サービスの利用にあたり、以下の行為を行ってはなりません。
本サービスでは、利用者が作成したカスタムステージに名前を付けて公開し、他の利用者が検索して遊べる機能を提供する場合があります。また、利用者が設定した表示名（プレイヤー名）は、オンライン対戦の相手やランキングにおいて他の利用者に表示されます。以下、これらを総称して「投稿コンテンツ」といいます。
現在のアプリ版では広告を表示していません。Web版および将来のアプリ版では、運営のために広告を表示することがあります。広告は第三者の広告事業者により配信されるものであり、当方は広告の内容・広告主・リンク先および広告を通じて行われる取引について、一切の責任を負いません。広告に関する取引・トラブルは、利用者と広告主等との間で解決していただきます。広告事業者による情報の取り扱いについては、プライバシーポリシーをご確認ください。広告の有無・表示形式・頻度は、予告なく変更されることがあります。
現時点で、当方は本サービス内で有料の販売を行っていません。当方は将来、アプリ内購入・サブスクリプション等の有料の提供を行うことがあります。その場合は、以下の条件によるものとします。
本サービスでは、ヒント・ストップ等のゲーム内アイテムや、復活・救済といったゲーム内の特典を提供することがあります。これらについて、以下の条件が適用されます。
設定・ハイスコア・進行状況などは、原則として利用者の端末内（localStorage）に保存されます。アプリの削除、ブラウザのデータ消去、本サービス内の「データ消去」の実行、端末の変更等により、これらのデータは失われます。当方は、これらのデータの保存・復元・移行を保証せず、その消失について責任を負いません。
本サービスおよび本サービスを構成するプログラム・画像・音声・文章・デザイン等に関する著作権その他の知的財産権は、当方または正当な権利者に帰属します。本規約は、これらの権利を利用者へ譲渡・許諾するものではありません。利用者には、本規約に従い、私的かつ非商業的に本サービスを利用する、譲渡不可・非独占的な権利のみが与えられます。プレイ動画・スクリーンショットの個人的な共有は、本規約および法令に反しない範囲で行うことができます。
当方は、利用者が本規約に違反した場合、または違反のおそれがあると当方が合理的に判断した場合、事前の通知なく、本サービスの全部または一部の利用の停止・制限、記録の削除、レートの修正・リセット、アクセスの遮断等の措置を行うことがあります。これらの措置により利用者に生じた不利益について、当方に故意または重大な過失がある場合を除き、当方は責任を負いません。（当方が責任を負う場合の賠償の範囲および上限は、第17条に定めるとおりとします。）当方は、これらの措置の理由を開示する義務を負いません。
本サービスは「現状有姿（AS IS）」で提供されます。当方は、本サービスについて、明示・黙示を問わず、正確性・完全性・有用性・特定目的への適合性・継続性・エラーやバグがないこと・セキュリティ上の欠陥がないこと・第三者の権利を侵害しないことを含め、いかなる保証も行いません。ただし、本規約が消費者契約に該当する場合において、法令によりこの保証の否認の効力が制限されるときは、その限度で適用されません。当方は、本サービスの利用または利用不能により利用者に生じた損害について、当方に故意または重大な過失がある場合を除き、責任を負いません。当方が責任を負う場合の賠償の範囲および上限は、第17条に定めるとおりとします。
当方の故意または重大な過失による場合を除き、当方は、本サービスに関して利用者に生じた損害のうち、特別損害・逸失利益・データの消失・事業機会の喪失その他の間接損害について、責任を負いません。当方が責任を負う場合であっても、その賠償額は、当該損害の原因となった事象が発生した時点から遡って6か月間に、利用者が当該事象に直接関連して当方に支払った金額（支払いがない場合は0円）を上限とします。消費者契約法その他の強行法規により本条の一部が適用されない場合、当該適用されない部分については、法令上許される最大限の範囲で責任を制限するものとします。
本サービスにおける情報の取り扱いは、プライバシーポリシーに従います。プライバシーポリシーは本規約の一部を構成します。
当方は、本規約を必要に応じて変更することがあります。変更を行う場合は、変更後の内容および効力発生日を、効力発生日が到来するまでに、本ページまたは本サービス内で周知します。利用者に重大な不利益を及ぼす変更を行う場合は、相当な予告期間を置きます。変更後の規約は、周知した効力発生日から適用されます。効力発生日以後に本サービスを利用された場合、変更後の規約に同意したものとみなします。
本規約のいずれかの条項またはその一部が無効または執行不能と判断された場合であっても、本規約の残りの部分は、引き続き完全に効力を有します。
本規約の準拠法は日本法とします。本サービスまたは本規約に関して利用者と当方との間に紛争が生じた場合には、当方の所在地を管轄する地方裁判所または簡易裁判所を第一審の合意管轄裁判所とします。ただし、利用者が消費者である場合、法令により認められる裁判所の管轄を排除するものではありません。

These Terms govern your use of Cram Farm (the "Service"), including the web and app versions and any online features. By using the Service you agree to these Terms. If you do not agree, please do not use the Service. In the event of any inconsistency between the Japanese and English versions, the Japanese version prevails.
Cram Farm is a memory game in which pairs are matched by cry. Core play is free. Online features (versus, ranking, publishing and searching custom stages) require an internet connection; data charges are your responsibility.
We may change, add to, or remove any part of the Service (including gameplay, balance, modes, and benefits) without notice, and may suspend or discontinue all or part of the Service at any time without notice. Except in cases of our willful misconduct or gross negligence, we are not liable for any resulting disadvantage. (Where we are liable, the scope and cap of compensation are as set out in section 17.)
You are responsible, at your own cost, for the device, software, and network connection needed to use the Service. We do not guarantee operation on every device, browser, or operating system.
If you are a minor, use the Service only with the prior consent of a parent or guardian. Any future in-app purchase by a minor requires such consent.
Online features require a display name. Do not enter personal information. Names that impersonate others, are offensive, discriminatory, obscene, infringing, unlawful, or promotional are prohibited. We may change, remove, or hide any name we consider inappropriate, without prior notice. Display names are not unique and do not verify identity.
Online play includes rated matches, casual matches, and private rooms opened with a passphrase. Anyone who knows the passphrase can join that room — sharing it is at your own risk, including exposure on streams or social media. Server-side determinations of match progress, results, and rating are authoritative. We may correct, reset, exclude, or delete ratings, rankings, match records, and published data at our discretion and without prior notice, including where we suspect a defect or misconduct. Matches may be interrupted or voided due to connectivity, device, or server conditions. We do not guarantee the accuracy or retention of results, ratings, scores, or records, and except in cases of our willful misconduct or gross negligence, we are not liable for their loss or alteration.
Online features are provided as is. We do not warrant continuous or uninterrupted operation, response times, or any retention period for data. Online features may be changed, suspended, or discontinued without notice. Depending on our hosting arrangements, servers may sleep after periods of inactivity and take time to respond. Data stored on the server may be deleted without notice. Except in cases of our willful misconduct or gross negligence, we are not liable for any damage arising from the foregoing. (Where we are liable, the scope and cap of compensation are as set out in section 17.)
You must not: violate any law or public order; gain unauthorized access to, reverse engineer, analyze, or modify the Service or its servers; play using modified clients or tools, or tamper with communications; use bots, macros, or other automation; manipulate scores, ratings, rankings, or analytics, or submit false data; deliberately disconnect, stall, or delay matches; collude with others to fix outcomes, or use multiple accounts, devices, or identifiers to manipulate rating or rankings; harass, defame, discriminate against, or impersonate others; place excessive load on the Service; use the Service commercially, or copy, distribute, or sell it without permission; or engage in any conduct we reasonably consider inappropriate.
The Service may let you publish a named custom stage that other users can search and play. In addition, the display name (player name) you set is shown to other users in online matches and rankings. These are collectively referred to as "UGC". You are responsible for your UGC; we are not responsible for its content. Do not post content that infringes third-party rights, is offensive, obscene, discriminatory, violent, promotional, contains personal information, or is otherwise unlawful or contrary to public order. We are under no obligation to review UGC in advance. We may delete, unpublish, or modify UGC and suspend the user's access, at our discretion and without prior notice. You grant us a free, non-exclusive, sublicensable license to reproduce, publish, distribute, and adapt your UGC as necessary to operate, maintain, improve, and promote the Service. Retention of UGC is not guaranteed and it may be deleted without notice. You can withdraw a stage you published at any time using the delete button in the community stages list. To report infringing or inappropriate UGC, use the contact channel below; we will take action where we consider it necessary.
We may display advertising to support the Service. Advertising is delivered by third parties, and we accept no responsibility for the content of ads, advertisers, linked destinations, or any transaction conducted through them. Any dispute concerning an advertisement must be resolved between you and the advertiser. See our Privacy Policy for how ad providers handle information. The presence, format, and frequency of ads may change without notice.
We do not currently sell anything within the Service. We may offer in-app purchases or subscriptions in the future. If we do: orders, payment, and refunds are governed by the terms and processes of the platform used for the purchase (e.g., Apple App Store, Google Play), which we do not control; we have no refund obligation except as required by law or by those platform terms; prices, contents, availability, and amounts granted may change or end without notice, with no compensation for differences; minors require parental consent; and where required, we will separately publish the disclosures mandated by Japan's Act on Specified Commercial Transactions and other applicable law.
Items (such as hints or stop) and benefits (such as revive or rescue) are a license to use within the Service only and confer no ownership or property right. They have no real-world monetary value, cannot be exchanged for cash or goods, and cannot be transferred, lent, or sold. They are non-refundable. They may be lost when the Service or a feature ends, when you clear your data, or if your access is suspended, without compensation. Grant conditions, effects, availability, caps, and usage limits may change without notice. Using certain items may make a run ineligible for rankings; this treatment may change without notice.
Settings, high scores, and progress are stored on your device (localStorage). Deleting the app, clearing browser data, using "Erase data" in the Service, or changing devices will lose them. We do not guarantee storage, restoration, or transfer of this data and are not liable for its loss.
All intellectual property in the Service belongs to us or our licensors. You receive only a non-exclusive, non-transferable right to use the Service personally and non-commercially under these Terms. Personal sharing of screenshots and gameplay video is permitted where consistent with these Terms and applicable law.
If you breach these Terms, or we reasonably suspect a breach, we may without prior notice suspend or restrict your use of all or part of the Service, delete records, correct or reset ratings, or block access. Except in cases of our willful misconduct or gross negligence, we are not liable for any resulting disadvantage, and we are not obliged to disclose our reasons. (Where we are liable, the scope and cap of compensation are as set out in section 17.)
The Service is provided "AS IS". We disclaim all warranties, express or implied, including accuracy, completeness, usefulness, fitness for a particular purpose, continuity, freedom from bugs or security defects, and non-infringement. However, where these Terms constitute a consumer contract and applicable law restricts the effect of such a disclaimer, the disclaimer does not apply to that extent. Except in cases of our willful misconduct or gross negligence, we are not liable for any damage arising from use of or inability to use the Service. (Where we are liable, the scope and cap of compensation are as set out in section 17.)
Except in cases of our willful misconduct or gross negligence, we are not liable for special, consequential, or indirect damages, lost profits, lost data, or lost business opportunity. Where we are liable, our aggregate liability is limited to the amount you paid us in direct connection with the relevant event during the six months preceding it (zero if no payment was made). Where mandatory law (including Japan's Consumer Contract Act) prevents part of this clause from applying, liability is limited to the maximum extent otherwise permitted.
Our handling of information is described in the Privacy Policy, which forms part of these Terms.
We may revise these Terms. Revisions take effect when posted on this page; significant changes will be announced here or in the Service. Continued use after a change constitutes acceptance.
If any provision is held invalid or unenforceable, the remainder of these Terms remains in full force.
These Terms are governed by the laws of Japan. Any dispute arising from the Service or these Terms shall be subject to the exclusive jurisdiction of the district court having jurisdiction over our location, as the court of first instance.
